Terms and Conditions of Participation

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY REGISTERING FOR AND/OR PARTICIPATING IN THE RIVERSIDE FREEDOM RUN (THE "EVENT"), YOU (OR YOUR PARENT/LEGAL GUARDIAN IF YOU ARE UNDER 18 YEARS OF AGE) ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

1. Introduction

Welcome to the Riverside Freedom Run! This Event is organized by the Riverside Freedom Run Committee ("Event Organizers"). These Terms and Conditions ("T&Cs") govern your registration and participation in the Event.

2. Event Details

  • Event Name: Riverside Freedom Run
  • Nature: A free, non-competitive running/walking/biking event
  • Location: 7 N 700 W, Blackfoot, ID 83221

3. Participant Eligibility and Registration

  • Age: Participants under the age of 18 must have the consent of a parent or legal guardian who has also read and agreed to these T&Cs. Children under 12 must be accompanied by a registered adult participant.
  • Health and Fitness: By registering, you confirm that you are in good health and physically fit to participate in this Event. You acknowledge that running is a strenuous activity that requires a certain level of physical fitness. It is your responsibility to consult with a medical professional prior to the Event if you have any health concerns.
  • Accurate Information: You agree to provide true, accurate, current, and complete information during the registration process.

4. Assumption of Risk, Waiver of Liability, and Indemnification

  • ACKNOWLEDGEMENT OF RISK: You understand and acknowledge that participation in a running event involves inherent risks and dangers of accidents, personal injury (including, but not limited to, sprains, muscle strains, fractures, heat and cold injuries, overexertion, dehydration, cardiac arrest, and even death), and property loss or damage. These risks may arise from your own actions or inactions, the actions or inactions of others (including other participants, volunteers, spectators, or Event staff), the condition of the event course or premises, or the negligence of the "Released Parties" (defined below).
  • ASSUMPTION OF RISK: You voluntarily and freely assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties or others, and assume full responsibility for your participation in the Event.
  • WAIVER OF LIABILITY: In consideration of being permitted to participate in the Event, you, for yourself, your heirs, executors, administrators, personal representatives, successors, and assigns, hereby WAIVE, RELEASE, DISCHARGE, AND COVENANT NOT TO SUE the Event Organizers, the City of Blackfoot, all Event sponsors, advertisers, volunteers, contractors, officials, and the owners or lessors of the premises used to conduct the Event, and all of their respective directors, officers, employees, agents, and representatives (collectively, the "Released Parties"), from any and all liability, claims, demands, losses, or damages on your account caused or alleged to be caused in whole or in part by your participation in the Event, including, but not limited to, any injury, disability, death, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by law.
  • INDEMNIFICATION: You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your participation in the Event, including, but not limited to, any claims based on your own negligence or willful misconduct, or your breach of these T&Cs.

5. Medical

  • Medical Condition: You attest that you are not aware of any medical condition that would affect your ability to safely participate in the Event. If you have any pre-existing medical conditions, you confirm you have consulted a doctor and received approval for participation.
  • Consent to Medical Treatment: In the event of an injury or illness during the Event, you consent to receive medical treatment deemed necessary by Event medical personnel or qualified professionals. You understand and agree that you are solely responsible for all costs associated with such medical treatment and any related transport.
  • No Medical Insurance Provided: The Event Organizers do not provide any medical insurance coverage for participants. You are responsible for your own medical insurance.

6. Rules of Participation and Conduct

  • Compliance: You agree to comply with all rules, regulations, and instructions given by Event Organizers, officials, medical staff, and security personnel before, during, and after the Event.
  • Safety: You agree to exercise caution and be mindful of your own safety and the safety of others at all times. Stay on the designated course.
  • Prohibited Items: The following items are prohibited on the course (unless explicitly permitted for specific accessibility reasons): bicycles, roller skates, inline skates, skateboards, scooters, animals (except for registered service animals), and any other items deemed unsafe or inappropriate by the Event Organizers.
  • Headphones: The use of headphones is discouraged for safety reasons, so you can hear instructions and be aware of your surroundings. If you choose to use them, you do so at your own risk.
  • No Transfer of Entry: Your registration is personal to you and may not be transferred or sold to any other person.
  • Respectful Conduct: You agree to behave in a respectful and sportsmanlike manner towards fellow participants, volunteers, staff, and spectators. Any form of harassment, discrimination, or unsportsmanlike conduct will not be tolerated and may result in removal from the Event.

7. Use of Name, Likeness, and Event Materials

  • Photography and Videography: You grant the Event Organizers and their authorized representatives the irrevocable, worldwide, and perpetual right to photograph, videotape, record, and otherwise capture your likeness, voice, and image during your participation in the Event (collectively, "Images").
  • Use of Images: You consent to the Event Organizers using, reproducing, distributing, displaying, and creating derivative works from the Images, in whole or in part, in any and all media now known or hereafter devised, for any legitimate purpose, including but not limited to, promotional materials, advertising, social media, and archival purposes, without further notice, review, consent, or compensation to you.
  • Event Materials: All materials provided by the Event Organizers in connection with the Event are and will remain the property of the Event Organizers.

8. Event Modification, Postponement, or Cancellation

  • The Event Organizers reserve the right to modify, postpone, or cancel the Event, in whole or in part, at their sole discretion, for any reason, including but not limited to, adverse weather conditions, natural disasters, acts of God, terrorism, public health concerns, safety concerns, governmental directives, or any other circumstances beyond their reasonable control.
  • In the event of cancellation or postponement, the Event Organizers will endeavor to notify registered participants via the Event website (riversidefreedomrun.com) and/or email, but shall not be liable for any failure to do so.
  • As this is a free event, no refunds will be applicable. The Event Organizers will not be liable for any costs or expenses incurred by participants as a result of such modification, postponement, or cancellation.

9. Personal Data

  • By registering for the Event, you consent to the collection, use, and storage of your personal information by the Event Organizers for purposes related to the organization and administration of the Event, including communication about this Event and future events.
  • The Event Organizers will take reasonable steps to protect your personal information but cannot guarantee its absolute security.

10. Governing Law and Jurisdiction

These T&Cs shall be governed by and construed in accordance with the laws of the State of Idaho without regard to its conflict of law principles. Any dispute arising out of or in connection with these T&Cs or your participation in the Event shall be subject to the exclusive jurisdiction of the courts located in Bingham County, Idaho.

11. Severability

If any provision of these T&Cs is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining T&Cs, and the remainder of the T&Cs shall continue in full force and effect.

12. Entire Agreement

These T&Cs constitute the entire agreement between you and the Event Organizers with respect to your participation in the Event and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

13. Amendments

The Event Organizers reserve the right to amend these T&Cs at any time. Any amendments will be posted on the Event website (riversidefreedomrun.com) and will be effective immediately upon posting. Your continued participation in the Event following the posting of amended T&Cs will signify your acceptance of such amendments.
